Simple and transparent Terms and Conditions…
We have kept our terms and conditions fair and reasonable, there are no hidden extras to worry about, by instructing BRO Architecture Ltd you agree to our terms and conditions as set out below. We are happy to provide the below in writing via, email or post
Put simply, by sticking to our below T&C’s we are able to deliver a level of service your project requires whilst avoiding any misunderstandings or issues during our working relationship.
Our General Terms and Conditions:
A. We provide general pre-project advice and shall provide a fixed fee quotation without charge;
B. There shall be no up-front fees to pay before your site visit; after a measured survey some projects depending on value may required a deposit.
C. We shall arrange for your site survey to be undertaken if we are in agreement that you will be very likely to use our service;
D. The site survey will be undertaken to assess the feasibility of your requirements (excluding condition P below), there shall be no obligation to instruct us to proceed with your project and there shall be no fees to pay if you decide not to proceed;
E. If you decide to proceed with our service you shall be required to provide written instruction, this will enable us to undertake the measured survey that will be required to produce your as existing house drawings. Your instruction to proceed can be cancelled following the site survey but there shall be a cancellation fee of £295.00 if you choose to do so;
F. We shall produce the necessary As Existing Floor Plans and Elevations for your project and deliver them to you via email and in PDF format - usually within 5/7 working days of the site visit however this doesn’t include weekends, bank holidays and my holidays;
G. We shall issue the first invoice with the As Existing drawings. The first invoice should be paid within 2 days of its issue;
H. Each project shall have a 28 days unlimited development time opportunity. The 28 days shall begin on the date of issue of the first invoice;
I. There shall be a limit of 5 changes to your project during the 28 days of development time. If your project requires more than 28 days of development time, there shall be a reasonable fee to extend your time slot;
J. When you are in agreement that the scheme is complete we shall finalise the planning drawings, prepare and submit your planning application. We shall deal with the planning department on your behalf, but do not take reasonability for the process or outcome, you will be required to chase and confirm documentation with them. We retain the right to make changes at the request of the planning authority/officer to drawings to enable them to grant planning without prior notice to you, we will endeavour to inform you of the changes, however if planning will not be supported or refused without changes we will make the changes to ensure planning is granted, Fees for any planning application are not included in our package and you will be provided with instructions on how to make payment;
K. Fees for the upgrade of the planning drawings to your building regulations package will be required to be paid upon your instruction to proceed;
L. It shall take approximately 25 working days to produce your building regulations package;
M. Structural design work is not included within our standard packages, if it is agreed and included then it is done via an online service that produces the calculations via our input (any pricing provided for structural calculation will be via this service unless specified) if you wish us to use an independent structural engineer this can be done and provided at an additional cost to you as the client, this is available upon request. Once the building regulations package has been produced we shall request a competitive quotation for the work that your project will require. You are not obliged to use the structural engineer that we recommend;.
Structural calculations are charged as a per beam service, if any changes are required due to site changes, issues or amendments then any required revisit and additional calculations are and will be chargeable at an agreed rate/s.
N. We shall prepare and submit your building regulations package for approval. We shall deal directly with building control on your behalf to ensure compliance. Fees for building control plan checks and site visits are not included within our packages; and (We do not recommend you proceed to commence any work until all information is completed/signed off whether by planning or building regulations, we take no responsibility for delays or costs to a project that is started prior to all drawings or documentation sign off! We furthermore do not accept costs if our timescales; should additional work be required do not work with yours, we will do our upmost to get all information completed however we cannot and do not control external individuals or companies or manage their timescales, we work in list order as work is received this is the fairest method so all client are treated equally).
O. Once approved, we can print and issue 1No full paper copies of your planning and building regulations packages through the post but an additional fee of £45.00 is chargeable for this service
P. Site Visit: We do not lift manhole covers nor do we survey drainage, all drainage should be surveyed prior to any building work starting and details provided to us to confirm on drawings if required as part of the scheme.
Drainage surveys should confirm location, depth and suitability that it can be used for the proposed scheme, there are specialist drainage engineers that can be instructed to design and confirm suitability after a camera survey is instructed and completed by a competent company.
Q. Assumptions During Site Visits: We, unlike builders do not have the ability to knock down or break into walls, ceilings or/and dig holes, we have to assume existing structures have foundations, that existing walls are as measured in terms of thickness and we are not able to confirm the thickness of any party wall, these elements will be assumed at the time of drawing unless the client can provide these details with the help of a builder prior or during our measured survey.
R. Permitted development rules - Whilst we will express our opinion on these they are a massive grey area and we recommend you speak to your local council to confirm before you start your build, should it turns out you require planning we can of course assist you with this element!
S. Measurements: whilst we take all care to ensure measurements are correct it is the client responsibility to ensure the measurements work for them, you will be asked to check and confirm the drawings before any submittal and this includes the measurements displayed on them, if a measurement isn’t shown then it is advised to ask, we take no responsibly if measurements are wrong at the point of building or an issue causes delay, sometimes it may be a human or environmental error but errors need to be reported to our office prior to the submittal of plans to planning or building control.
When you instruct us to proceed, we shall arrange a measured survey which enables us to continue with the production of your As Existing Floor Plans and Elevations. If the client provide drawings for reproduction then we will assume the measurements are correct and suitable as the client would have checked them before providing them to us. We take no responsibility for issues caused from reproduction of client provided drawings.
Your verbal or written instruction will mean we both will be following our terms and conditions which shall form the agreement:
1. The Planning Drawings fee shall become payable in full within 1 days of the issue of the As Existing Floor Plans and Elevations drawings in PDF format.
2. All drawings are for planning or building regulations, or both and not structural or structurally designed, we recommend if the design has structural features such as beams, roofs, floors, openings, timbers they are checked by a qualified structural engineer before works are started we take no responsibility for works other then planning and building regulations. NOTE: Building Regulations Drawings aren’t structural drawings!
3. Development of proposed sketches (the Development Phase of the works) shall commence only upon receipt of the Planning Drawings fees in full.
4. If the Planning Drawings fees are not cleared in full within the allotted time scale we shall cancel progression to the development phase of the works, without warning or notification. A standard fee of £295.00 + VAT for the site visit, measured survey and production of the As Existing Floor Plans and Elevations shall still be payable in full within 14 days of notice of cancellation.
5. You can cancel your instruction to proceed within 14 days. A standard fee of £295.00 + VAT for the site visit, measured survey and production of the As Existing Floor Plans and Elevations shall be payable in full.
6. A cancelled project shall be given the opportunity to have a replacement development time slot allocated, which shall incur a booking fee of £95.00 + VAT in addition to the balance of the standard Phase 1 Planning Drawings fees.
7. During the development phase of the works there shall be no limit to the number of changes and modifications to the scheme made in the interests of positive and reasonable progression towards a defined scope of works. Reversion development works will attract re-design fees which shall be agreed in writing prior to commencement.
8. The duration of the Development Phase of the works shall be limited to 28 days from issue of the Phase 1 Planning Drawings Fees invoice. Extension of the Development Phase shall incur reasonable fees which shall be agreed in writing.
9. The Development Phase of the works shall be complete when agreement is made that finalised drawings are ready to be issued for Planning Permission and/or upgrade to Building Regulations.
10. Changes to the Planning Drawings scheme may be made after the drawings have been agreed as finalised. All changes to the finalised scheme shall incur reasonable fees, the minimum fee for changes to a final scheme shall be £40.00 + VAT and the maximum fee shall be £400.00 + VAT, which shall be agreed upon in writing prior to the commencement of the required additional works.
11. Changes to a finalised scheme to suit requirements of the Planning Department shall incur fees in accordance with clause 9. Once planning has been decided, whether passed or failed this then ends our contract, if your planning is not granted we will not produce the building regulations drawings (if outstanding) no fees are refundable after planning has been submitted or decided.
Any amendments after the planning phase are chargeable at our normal fee schedule (available upon request). We do not guarantee planning permission this is a governmental process, we do our best obtain planning permission and in most cases are successful reference the first section for further information.
12. Notice of 14 days shall be required prior to the delivery of Building Regulations Drawings/Documentation. The latest revision of the Planning Drawings at the time of instruction shall be upgraded to create the Building Regulations Drawings/Documentation.
13. Fees for the production of Building Regulations Drawings/Documentation shall be payable within 14 days of the issue of the Final Invoice and prior to commencement of the upgrade works.
14. Changes to the Building Regulations Package shall incur reasonable fees, the minimum fee for changes to a final scheme shall be £60.00 + VAT and the maximum fee shall be £465.00 + VAT, which shall be agreed upon in writing prior to the commencement of the required additional works.
15. There shall be no fees for changes to a scheme to satisfy the requirements of Building Control during their plan check process.
16. Fees for Planning Applications, Building Control Applications, Structural Calculations and Specialist Surveys or Reports are not included and shall be paid directly to the 3rd party by the customer.
